1. Who you're contracting with
These Terms govern your use of Smileinator (the "Service"), operated by Smileinator ("we", "us", "our"). By using the Service you agree to these Terms.
2. The Service
Smileinator is a web app that uses on-device machine learning to detect smiles via your camera and tracks aggregated stats, streaks and group leaderboards. Some features may require a paid subscription.
3. Acceptable use
You must not:
- • Use the Service unlawfully or fraudulently
- • Send spam or infringe intellectual property
- • Probe, scrape, reverse engineer or otherwise interfere with the Service or its security
- • Upload malware or attempt to disrupt other users
4. Account and credentials
You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
5. Intellectual property
Smileinator, including its software, design and branding, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal use within your chosen plan. You may not resell, redistribute or reverse engineer it.
6. Payments, subscriptions and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy.
Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel any time and keep access until the end of the current period.
7. Service level and warranties
The Service is provided "as is". We do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury where the law prohibits such limitation.
9. Suspension and termination
We may suspend or terminate access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends immediately.
10. Changes
We may update these Terms from time to time. Continued use of the Service after an update means you accept the new Terms.
